By accessing and using xtuis.com (the 'Service'), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these Terms, please do not use this Service. These Terms constitute a legally binding agreement between you and xtuis.com. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
xtuis.com provides an email notification service that allows users to send emails to themselves via a simple URL or API endpoint. The Service includes both free and paid subscription plans with different rate limits, features, and email quotas. Free plan includes 300 emails with a rate limit of 10 requests per minute. Paid plans include 50,000 emails with a rate limit of 120 requests per minute. We reserve the right to modify, add, or remove features at any time.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent and warrant that you meet these age requirements and have the legal capacity to enter into this agreement.
To use the Service, you must register with a valid, active email address. You are responsible for: (a) maintaining the confidentiality and security of your API key; (b) all activities that occur under your account, whether authorized by you or not; (c) ensuring your email address remains valid and accessible; (d) immediately notifying us of any unauthorized access or use of your account. You may not share your API key with third parties or use another user's API key. We are not liable for any loss or damage arising from your failure to comply with these security obligations.
You agree NOT to use the Service: (a) for any illegal purpose or in violation of any local, state, national, or international law or regulation; (b) to send spam, unsolicited bulk emails, phishing emails, or any form of harassment; (c) to transmit any malicious code, viruses, worms, Trojan horses, or other harmful or destructive content; (d) to attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks; (e) to interfere with, disrupt, or damage the Service, servers, or networks connected to the Service; (f) to use automated systems (bots, scrapers) to access the Service in a manner that sends more requests than a human could reasonably send; (g) to reverse engineer, decompile, or disassemble any part of the Service; (h) to use the Service to violate the rights of others, including intellectual property rights, privacy rights, or publicity rights. Violation of this section may result in immediate termination of your account and may subject you to legal action.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without prior notice. We do not guarantee that the Service will be available at all times, uninterrupted, secure, or error-free. We may perform scheduled or unscheduled maintenance that may result in temporary unavailability. We are not liable for any loss or damage resulting from Service unavailability. We reserve the right to change, suspend, or discontinue any feature or functionality of the Service at any time.
Paid subscription plans are available for purchase through our payment processor, Stripe. All fees are stated in U.S. dollars unless otherwise specified. By purchasing a paid plan, you agree to pay all charges associated with your subscription. All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms. In the event of a billing dispute, you must contact us within 30 days of the charge. We reserve the right to change our pricing at any time, but we will provide at least 30 days' notice for existing subscribers. Price changes will apply to subsequent billing cycles. You are responsible for all applicable taxes, duties, and government charges related to your purchase. If you are located in a jurisdiction that requires us to collect taxes, we will add such taxes to your purchase price.
Free plan users receive 300 emails with a rate limit of 10 requests per minute. Paid plan users receive 50,000 emails with a rate limit of 120 requests per minute. Email credits do not expire for paid plans. Free plan credits are subject to our fair use policy. We reserve the right to modify rate limits, email quotas, or plan features at any time with reasonable notice. If we make material changes that negatively affect your plan, you may cancel your subscription and receive a prorated refund for the unused portion of your subscription period.
Rate limits are enforced per API key. Free plan users are limited to 10 requests per minute. Paid plan users are limited to 120 requests per minute. We reserve the right to modify rate limits at any time. Attempts to circumvent rate limits through multiple accounts, API keys, or automated means may result in immediate account suspension. Excessive usage that may harm the Service, degrade performance for other users, or violate these Terms may result in temporary or permanent suspension of your account without refund.
The Service, including its original content, features, functionality, design, logos, trademarks, and all intellectual property rights therein, are owned by xtuis.com and its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
You retain ownership of any content you transmit through the Service (email subject and body). By using the Service, you grant us a limited license to transmit your content through our infrastructure to deliver emails to your specified recipient. We do not store the content of your emails on our servers after transmission. You are solely responsible for the content you send through the Service and represent that you have all necessary rights to transmit such content.
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL XTUIS.COM, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless xtuis.com, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees) arising from: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; (d) any content you submit, post, or transmit through the Service; or (e) any other party's access and use of the Service with your API key or account credentials.
You may terminate your account at any time by contacting us at contact@xtuis.com or using the unsubscribe link in emails. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to: (a) breach of these Terms; (b) violation of applicable laws or regulations; (c) requests by law enforcement or government agencies; (d) extended periods of inactivity; (e) fraudulent, abusive, or illegal activity; or (f) technical or security issues. Upon termination, your right to use the Service will immediately cease. We may delete your account and data associated with your account. All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We shall not be liable for any failure or delay in performance under these Terms which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, labor dispute, civil commotion, interruption of telecommunications services, interruption of power or other utility service, failure of third-party service providers, or any other cause beyond our reasonable control.
For any dispute arising from or relating to these Terms or the Service, you agree to first contact us at contact@xtuis.com to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of a recognized arbitration organization. You waive your right to a jury trial and to participate in a class action lawsuit. This section does not prevent either party from seeking injunctive relief in a court of competent jurisdiction.
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and trade and economic sanctions maintained by the U.S. Treasury Department's Office of Foreign Assets Control. You represent that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on this page and updating the 'Last Updated' date. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service and may cancel your account.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by our duly authorized representative.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and xtuis.com regarding the Service and supersede all prior and contemporaneous written or oral agreements between you and xtuis.com.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which xtuis.com operates, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in that jurisdiction for the purpose of litigating any disputes.
